It is intended to be read together with the Terms of Use, which remain the primary and binding legal agreement governing your use of Mintly.

If any discrepancies arise between this document and the Terms of Use, the Terms of Use shall prevail.

1. Disclaimer of Responsibility

1.1. Service Provided “As Is”

Mintly is provided strictly on an “as is” and “as available” basis. The Service may function, fail, become unavailable, or behave unexpectedly at any time. Your use of Mintly is entirely at your own risk.

1.2. No Liability for Token Creation

Mintly does not assume any responsibility or liability for:

• smart contracts or tokens created using the Service,

• the legal, financial, or any other consequences of token deployment,

• user mistakes, misconfigurations, or unintended parameters,

• the behaviour, performance, or outcomes of deployed tokens.

All results of token creation are solely the responsibility of the User.

1.3. No Control Over Blockchain or Smart Contracts

Mintly does not control:

• blockchain networks, validators, or consensus mechanisms,

• the execution, confirmation, or failure of transactions,

• the immutability of deployed smart contracts,

• the distribution, transfer, or management of tokens.

Mintly cannot reverse, modify, halt, or correct any blockchain action.

1.4. No Financial, Legal, or Investment Advice

Mintly is not a financial advisor, legal advisor, investment intermediary, broker, or exchange. Nothing in the Service should be interpreted as:

• financial advice,

• legal advice,

• tax advice,

• investment recommendations,

• evaluation or approval of tokens.

Users must seek independent professional advice when needed.

1.5. No Endorsement or Review of Tokens

Mintly does not evaluate, review, audit, verify, endorse, or approve any smart contracts, token parameters, projects, or tokens created by Users.

1.6. External Risks and Cybersecurity

Mintly is not responsible for damages resulting from:

• hacking, security breaches, malware, or phishing attacks,

• fake or malicious bots impersonating Mintly,

• vulnerabilities in third-party wallets,

• failures of Telegram, operating systems, browsers, or infrastructure,

• exploits or attacks on blockchain networks.

2. Privacy Policy

2.1. No Personal Data Collection

Mintly does not collect, store, or process personal data such as:

• names,

• emails,

• phone numbers,

• personal identifiers,

• private messages.

Mintly interacts only with technical information required for operation.

2.2. No Access to Private Keys or Wallet Credentials

Mintly does not:

• request or store private keys,

• request seed phrases,

• access wallets,

• manage transactions directly.

All transactions initiated through Mintly are signed by the User through their own non-custodial wallet. The wallet that signs the deployment transaction becomes the owner of the deployed smart contract.

2.3. Minimal Technical Logging

For operational stability, security, and abuse prevention, Mintly may store limited technical data, including:

• Telegram user identifiers,

• timestamps of actions,

• blockchain network selection,

• deployment metadata.

Mintly processes only the data provided by the Telegram Bot Platform and does not collect data independently.

Blockchain-related information processed by Mintly is publicly available on the respective blockchain networks.

These logs do not contain sensitive or personally identifiable information.

2.4. Purpose of Data Processing

Technical data may be used only for:

• ensuring correct functioning of the Service,

• preventing fraud or abuse,

• managing rate limits or restrictions,

• diagnosing and resolving technical issues.

Mintly does not sell, rent, share, or commercialize user data for advertising or third-party marketing.

2.5. Sharing of Data

Mintly does not share any technical or user data with third parties except:

• when required by applicable law,

• in response to lawful requests from competent authorities.

2.6. Data Retention

Mintly retains technical logs only for the minimum duration necessary to ensure service integrity. Logs may be deleted periodically or upon internal review.

3. Relationship to the Terms of Use

This Privacy Policy & Disclaimer is an extension of the Terms of Use and must be interpreted together with them.

In any case of inconsistency or ambiguity, the Terms of Use shall prevail and control.
